In the US Code, Manslaughter is deemed the unlawful killing of a human being without malice. According to the law, there are two types. The first, voluntary, is described as happening during a sudden quarrel or heat of passion. Involuntary, the second, is during the commission of a non-felonious, unlawful act, without due caution or circumspection.

The different situations that arise in the death of another human being merit a very close investigation into the details surrounding the event. Mens Rea, or the mental mindset of the person committing the crime, deals with the element of killing or seriously injuring a person negligently or recklessly. Actus Reus, is the actual commission of killing another person. Thus, careful consideration is given to these elements in determining the punishment of the responsible party for the death.
